Terms of Service

Please read these terms carefully before using our HVAC services. These terms govern your use of Jupitair HVAC services throughout North Texas.

1. Acceptance of Terms

By engaging Jupitair HVAC for any service, requesting an estimate, or using our website, you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("Customer" or "you") and Jupitair HVAC ("Company," "we," "us," or "our").

If you do not agree to these Terms, you may not use our services or website. Your continued use of our services after any modifications to these Terms constitutes acceptance of such modifications.

2. Service Description and Scope

Jupitair HVAC provides professional heating, ventilation, and air conditioning services throughout North Texas, including but not limited to:

  • HVAC system installation and replacement
  • Air conditioning repair and maintenance
  • Heating system repair and maintenance
  • Duct cleaning and repair services
  • Thermostat installation and programming
  • Energy efficiency upgrades
  • Emergency HVAC services
  • Commercial and residential HVAC services

All services are performed by licensed and certified technicians in accordance with applicable local, state, and federal regulations. Service availability may vary by location within our service area.

3. Customer Responsibilities

As a customer, you agree to:

  • Provide accurate and complete information regarding your HVAC system and service needs
  • Ensure safe and unobstructed access to HVAC equipment and work areas
  • Remove or secure personal property that may interfere with service delivery
  • Be present or designate an authorized representative during service appointments
  • Comply with all safety instructions provided by our technicians
  • Maintain your HVAC system according to manufacturer recommendations between service visits
  • Report any issues or concerns promptly to allow for timely resolution
  • Provide payment in accordance with agreed terms

Failure to meet these responsibilities may result in service delays, additional charges, or cancellation of services.

4. Payment Terms and Pricing

Estimates: We provide free estimates for HVAC installations and major repairs. Estimates are valid for 30 days unless otherwise specified.

Payment: Payment is due upon completion of services unless alternative arrangements have been made in writing. We accept cash, check, and all major credit cards. Payment plans may be discussed on a case-by-case basis.

Pricing: All prices are subject to change without notice. Final pricing will be confirmed before work begins. Additional charges may apply for:

  • Emergency or after-hours service calls
  • Travel beyond our standard service area
  • Additional work discovered during service
  • Parts and materials not included in initial estimate
  • Permit fees and inspection costs

Late Payment: Accounts not paid within 30 days may be subject to a 1.5% monthly service charge and collection activities.

5. Warranty and Guarantee Policies

Service Warranty: We warrant our workmanship for one (1) year from the date of service completion. This warranty covers defects in our installation or repair work but does not cover normal wear and tear, damage caused by misuse, or issues related to pre-existing conditions.

Equipment Warranty: New equipment installations are covered by manufacturer warranties. We will assist with warranty claims but are not responsible for manufacturer warranty coverage or limitations.

Parts Warranty: Replacement parts are warranted according to manufacturer specifications, typically ranging from 90 days to 10 years depending on the component.

Warranty Limitations: Warranties are void if unauthorized modifications are made to the system, if the system is damaged by external factors beyond our control, or if recommended maintenance is not performed.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUPITAIR HVAC'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, BUSINESS INTERRUPTION, OR PERSONAL INCONVENIENCE, REGARDLESS OF THE THEORY OF LIABILITY.

We maintain comprehensive liability insurance as required by Texas law. Our liability is further limited by the terms of our insurance coverage.

7. Indemnification

Customer agrees to indemnify, defend, and hold harmless Jupitair HVAC, its employees, agents, and subcontractors from and against any claims, damages, losses, or expenses (including reasonable attorney fees) arising from: (a) Customer's breach of these Terms; (b) Customer's negligence or willful misconduct; (c) any third-party claims related to Customer's property or use of our services; or (d) any violation of applicable laws or regulations by Customer.

8. Dispute Resolution and Arbitration

Initial Resolution: We are committed to resolving any disputes amicably. Please contact us directly at (940) 390-5676 or Contact@jupitairhvac.com to discuss any concerns.

Mediation: If direct negotiation fails, disputes shall first be submitted to non-binding mediation through a qualified mediator in Collin County, Texas.

Arbitration: Any disputes that cannot be resolved through mediation shall be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Collin County, Texas.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions or representative proceedings.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Collin County, Texas, and the parties hereby consent to personal jurisdiction and venue therein.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new "Last Updated" date. Material changes will be communicated to existing customers via email or other reasonable means.

Your continued use of our services after modifications become effective constitutes acceptance of the updated Terms. If you do not agree to the modifications, you must discontinue use of our services.

11. Termination

Either party may terminate ongoing service agreements with reasonable notice. Jupitair HVAC reserves the right to refuse or discontinue service to any customer who:

  • Violates these Terms
  • Provides false or misleading information
  • Engages in abusive or threatening behavior toward our staff
  • Fails to pay for services rendered
  • Creates unsafe working conditions

Upon termination, Customer remains responsible for payment of all services rendered prior to termination.

12. Intellectual Property Rights

All content on our website, including text, graphics, logos, images, and software, is the property of Jupitair HVAC or its licensors and is protected by intellectual property laws. You may not use, reproduce, or distribute any content without our express written permission.

The Jupitair HVAC name, logo, and all related marks are trademarks of Jupitair HVAC. You may not use our trademarks without our prior written consent.

14. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects the original intent.

These Terms, together with any written service agreements, constitute the entire agreement between you and Jupitair HVAC regarding our services and supersede all prior or contemporaneous communications and proposals.
